The cost of personal evictions has been continuously increasing over previous times ten years. However, do not fault the attorneys. Our expenses have remained the same; all of the other associated expenses have been growing up around us like fresh mushrooms.
The complete “cost” of a property eviction is made up of two elements: the lawyer’s fee and essential lawsuits expenses compensated to third parties for such things as processing expenses, support of procedure, and lockout expenses. Right off the bat, you will have to have expenses for the court’s processing fee and the procedure server’s cost for providing the court action on the renter or renters.
The current processing fee for a property eviction case, in Florida for example, is $220.00 if the rental due is $10,000 or less. Most personal evictions fit into that classification. If the rental due is over $10,000.00 but less than $25,000.00, the processing fee goes up to $345.00. If the rental due surpasses $25,000.00 (hopefully, you will never be in such a case), the processing fee improves to $355.00.
One digression at this point, you may have come across advertisements-usually from non-lawyer eviction Attorneys although some attorneys also do it- offering “low-cost evictions” for “$199.00” or some other extremely low variety. Such advertising is deceiving. A property eviction, using Florida as an example again, cannot be done for that quantity. The processing fee alone is more. Look closely at the marketing and you will see the words “plus costs”. When you add in the expenses, the “low cost” property eviction leaps up to over $700.00.
Worse, since eviction Attorneys are not attorneys, if the renter competitions and test is necessary, you will have to seek the services of a lawyer or use the one that the eviction Attorneys provides at an extra cost. In such instance, the cost of the “low cost” property eviction improves to around $900.00, about the same that you’d have to pay to maintain a lawyer from the begin.
Additionally, look carefully at what services the eviction Attorneys provides for the supposed “low-cost.” Often times, the only support that the eviction Attorneys provides is to begin the case, i.e., to do the initial processing. If the renter then competitions, you are on your own. With some eviction Attorneys, they do not even handle the standard if the renter does not competition. In either event, you will have to seek the services of a lawyer at extra expense.
Back to cost. After you win you are case, you will have to apply your verdict with a lockout. A lockout is when the police goes to the property and actually eliminates the renter and regenerates ownership to the property owner. In Florida for example, the expense of a lockout is $150.00 for the sheriff’s cost and the writ of ownership. Thus, for an average property eviction case, the expenses for processing expenses support of procedure and lockout will usually run around $510.00. That quantity can be higher based on the quantity of mature residents or previous times due rental.
Last, but not least, is the small matter of the fee to be compensated to the diligent lawyer. Most hips, for easy cases, is less than the expenses. In San Paul where I practice, you can anticipate to pay, usually, around $400.00 predetermined fee for hips in an easy case and an extra $300.00 for hips if a test is necessary. Some attorneys will not do a flat-rate fee for evictions after property eviction, property eviction of Area 8 renters, and property eviction for a reason other than non-payment of rental or rental expiry, or times when the renter is showed by a lawyer. In such instances, the lawyer cost on per hour basis.
Most property eviction cases are for the non-payment of rental, the renters are unrepresented, the quantity in debate is under $10,000.00, there are two mature residents, and either no test occurs or there is a test but the renter does not have a lawyer. In such a case, you should anticipate to pay between $800.00 and $1,100.00 complete for expenses and hips to take the property eviction case all the way through verdict and lockout.
